Judge Walther has ruled — and wasn’t the suspense terrific? — that the 416 abducted FLDS children will remain in "temporary" state custody.

This, despite the fact (as explained below), that the abuse report that provided the pretext for the raid was contrived. This, despite the admission, under oath, of Bruce Perry of the ChildTrauma Academy — an "expert" witness on behalf of the state — that the foster care system "would be destructive to these kids."

As what follows will illustrate, Perry isn’t exaggerating one whit.

So … the warrant was based on a lie, the raid was therefore illegal, the children face the prospect of certain harm within the state foster care system — and Judge Walther is OK with this.

This underscores one of the reasons why it’s a bad idea to let women be judges: You can’t take a female judge out for a good horsewhipping when one is warranted.

The children suffer behind an iron curtain of corrupt secrecy. That curtain was lifted a few years ago, long enough to get a brief but terrifying glimpse of what was being done by people who had placed themselves beyond accountability.

Scores of children were killed, poisoned, beaten, and otherwise abused each year. Child rape was terrifyingly common: The largest group of victims were between 12 and 15 years of age, but thirteen percent of the victims were three years old or younger.

An official investigation of this secretive system was undertaken, but soon foundered over obstructions thrown up by those who had the most to lose if the full truth were revealed. But before the portcullis was slammed shut, the investigator learned that a child being raised in that system was four times more likely to die of criminal violence than a child in the general population.

The obvious course of action would be to mount an armed raid to liberate those children, but whatever necessary means, from the abusive system in which they’re being held.

Unfortunately, the entity that would carry out such an operation also presides over the systematic abuse. The findings described above are from an abortive investigation of the Texas Foster Care System conducted by Carole Keeton Strayhorn on behalf of the state Comptroller’s office.

"In April 2004 I said I would give our forgotten children in foster care something they need — a voice," recalls Strayhorn. "I have been and will continue to be their voice. This Governor’s Health and Human Services Commission continues to stonewall my investigation and this governor continues to hide the truth.

The data describing the various forms of abuse inflicted on foster children were compiled from information provided in 2004 by the Texas Department of Family and Protective Services — the same agency that abducted 416 children belonging to the Fundamentalist Latter-day Saints (FLDS) Church.

The pretext for seizing the FLDS children was an alleged report of sexual abuse from "Sarah," a 16-year-old "plural wife" in that community. That purported victim was supposedly impregnated at age 15; this meant, quite conveniently, that the procreative act violated a law passed by the state legislature specifically to criminalize the marriage practices of the FLDS community.

"Sarah" has not been found. I’m quite confident her supposed rescuers are displaying the same diligence in trying to find her that George W. Bush has manifest in hunting down Osama bin Laden.

That comparison isn’t fair, of course: Bin Laden does, or at least did, exist. "Sarah" almost certainly does not. And the various spokespeople for the state of Texas who are responsible for massaging public perceptions of the atrocity at YFZ Ranch, have made it clear that it doesn’t matter whether or not "Sarah" is found.

They’ve done what they intended: They’ve stolen the children, and they’re not going to give them back unless they’re literally forced to do so.

"I think some people have really focused on that [Sarah] but the reality is that her phone call is the reason we went out there, but it was not the reason for the removals," claimed DFPS shill Greg Cunningham. "The removals happened based on what we saw out there."

What, pray tell, did they see "out there"? We won’t find out until a court-appointed "Special Master" has had a chance to review — or, if necessary, contrive — the "evidence."

Here’s what the public has seen:

We witnessed a military assault, with armor provided by the Department of Homeland Security, against a peaceful, unresisting religious community.

We have seen happy, healthy, well-adjusted children who have been separated at gunpoint from loving mothers.

We have seen and heard women who have experienced the single worst thing that can happen to a parent — the loss of a child or children — present themselves with dignity and reserve in the face of arrogant aggression by a corrupt state bureaucracy (as if any other kind existed).

What we have not seen is any evidence that children were being abused in the FLDS community.

But there is ample evidence of systematic abuse of the most heinous kind in the foster care system into which the child-snatchers seek to place the FLDS children.

In 2004, noted Strayhorn, 38 foster children were killed; 48 were killed the following year. In addition, "about 100 children received treatment for poisoning from medications; 63 foster children received medical treatment for rape that occurred while in the foster care system; and 142 children gave birth while in the state foster care system."

"As alarming as these cases are," she continues, "we can only imagine how much worse the Fiscal 2005 data is because Gov. [Rick] Perry’s Health and Human Services Commission has refused to provide the data needed to complete my investigation."

During 2004, "four-year-old twins living in the same foster home received medical treatment in the hospital for rape," recalled Strayhorn. "A five year old boy in the same foster home received medical treatment in the hospital for rape two days later. A 15-year-old girl who was not pregnant when she entered our state’s foster care system in 2002 gave birth in February 2004….[A] 12-year-old boy died in December 2005, while in our state’s care, at a facility that treats children with learning disabilities and emotional problems. The boy suffocated while being restrained from behind by an employee of the facility."

"The crisis is minute-by-minute and child-by-child," concluded Strayhorn. "I renew my call [to Gov. Perry]. He must act now to save children’s lives."

Perry, or at least the government over which he presides, did eventually act to "save" children — by conducting a potentially lethal military raid against a community where they weren’t being abused, for the purpose of delivering them into a government-run system in which children are routinely killed, molested, and poisoned.

As an ABC News analysis points out, the DFPS legal strategy is to treat the people living in the YFZ enclave as a single household. In this fashion, under what the Texas government is pleased to call the "law," finding a single case of abuse within the community would be enough to justify keeping all of the children in permanent state custody.

Which means, of course, that they would become the property of a single collectivist "household." We could envision it as sort of a polygamous union between various foster homes and the state government, in its role as Parens Patriae. And in that collectivist household, abuse is widespread, frequently lethal, and protected by "law."

As legal proceedings in the FLDS custody battle began today (in — as the bitter ironies continue to accumulate — the Tom Green Courthouse), the presiding judge, Barbara L. Walther, was praised by all and sundry as the very soul of equity.

Judge Walther will give the FLDS "a fair shake," insisted attorney William Moore of San Angelo, where the case is being heard. Fellow attorney Guy Choate praised Walther for her command of details. And Robert Post, whom Walther defeated in the 1992 election in which she won her seat, insisted that the judge won’t be a "rubber stamp" for the state bureaucracy, but rather will "make them prove it up."

Judge Walther may be the embodiment of competence; she may be the essence of good intentions made flesh. But either through professional blindness or something more sinister she failed her first, and perhaps most important, test today:

She did not issue an order to the DFPS commanding them to produce "Sarah," with an inflexible and immediate deadline to do so.

Walther is the judge who issued an extravagantly overbroad warrant on the basis of "Sarah’s" alleged report. Today she admitted into evidence documents seized in that raid without confirming that there was a legal basis for the warrant.

By relieving the DFPS of the responsibility to produce the alleged witness that was the basis of that report, Walther has graduated from commonplace offenses against the Constitution to participation in a criminal conspiracy — assuming, as I think by now we should, that "Sarah" doesn’t exist.

The criminal conspiracy in this case involves the attempted — or, better put, not entirely consummated — theft of children by a state bureaucracy with a financial interest in enlarging the ranks of its foster care system, however miserable or dangerous that system is to its enrollees.

A quick postscript….

Obviously, the FLDS child abduction scandal is an incredibly important on-going story. At the risk of trying the patience of those who don’t find it as compelling as I do, it’s my intention to devote a lot of coverage to it, while doing my best not to become monomaniacal.

"Sarah" may have been found. If this lead is reliable, the abused 16-year-old FLDS child bride imprisoned at YFZ ranch in Texas is actually a 33-year-old prankster from Colorado Springs, Colorado named Rozita Swinton.

The FBI and Texas Rangers reportedly traced the call to Swinton, and the Rangers were in town to interview her Wednesday night — that is, the night before the legal hearing began in Judge Walther’s courtroom. This tends to italicize the point I made above: Judge Walther should have made confirming the validity of "Sarah"’s charge, or at least her existence, the first order of business on which everything else was contingent.

If Swinton is "Sarah," the entire rationale for the raid is invalid, of course. Not that this would deter the state of Texas from keeping the FLDS children anyway.

I remarked above about the manifold and ever-multiplying ironies of this case. We learn now that it was an adult black woman who most likely made the "Sarah" call, an irony best understood by those who know that the FLDS sect, like pre-1978 mainstream Mormonism, teaches that people of African ancestry bear a divine "curse" and thus they must not "mix their seed" with the elect.

To their credit, the leaders of the mainstream Mormon Church changed that doctrine in 1978.

This is the kind of horrifying, Soviet-style psychological torture regularly perpetrated by the child "welfare" system in Texas. Oh, but according to the testimony of Commissarina Angie Voss of the Texas DFPS, what is really scary is the sight of polite, cooperative, well-behaved children living in a small, insular, crowded, but peaceful religious community:

"Angie Voss testified she was escorted onto the YFZ Ranch in nearby Eldorado the night of April 3 by law enforcement officers. She was accompanied by a dozen case workers investigating complaints initially lodged by a 16-year-old girl named Sarah….

Voss said investigators hoped to find her among what they believed were about 150 people on the ranch.

In reality, there were more than 600 people there.

The supervisor testified that two men willingly let them inside after they had passed what she described as a guard tower several stories high with stairs leading to the top. She said there were men stationed at the tower.

She said she asked if there were any girls named Sarah living at the ranch. `They shook their heads and said there were no Sarahs living at the ranch,’ Voss said….

She said the girls filed in and appeared polite and respectful, but she was nevertheless concerned.

`It was a very scary environment — intimidating. I was afraid. I saw men all over. It felt like the schoolhouse was surrounded,’ she said, `It was a fearful kind of environment.’

Six hours after being on the ranch and talking to a variety of girls, Voss said the decision was made to remove some of the children from the complex."

The situation was "scary" in what way? Well, y’see, there was this palpable sense of incipient violence hanging in the air like the scent of an impending thunderstorm:

"`I heard a report that a tank was coming on the property. Things were getting more scary to me. It was a situation of a very huge magnitude with so many law enforcement officers around,’ she testified. The case workers wanted to interview the children in an environment that didn’t seem `so scary and dangerous.’"

Which is to say: The situation was "scary" because of the presence of the paramilitary Berserkers who had been sent to help Voss and her comrades kidnap the kids!

So we’re back to the old Bastiat formula for totalitarian government intervention — creating the "poison" and the "antidote" in the same laboratory. Or, if you will, leaving the arsonists in charge of the fire department — or the abusers in charge of the child "protection" apparatus.

Oh, and one last, and very important tidbit: Miss Voss has "worked" with the child survivors of the last significant venture in armed child "protection" to take place in Texas, the 1993 annihilation of the Branch Davidian community at Mt. Carmel.

    There was nothing lawful about the attack on that compound. Polygamy is not against God’s Law or the common law, and neither is “statutory rape”. If a father allows his daughter to marry a man, that is lawful. Many “laws” of this country and the state of Texas are not lawful and therefore, are no real laws at all. I’m not saying I like mormons of any kind, or would like the people in this compound, but in a Constitutional America, we can’t allow this kind of tyranny against the people.

    I’m all for freedom of religion. I have no problem with polgemy. As long as its ADULTS CONSENTING TO IT. If you marry off your 14, 15, 16 year old daughter to your 40 to 50 year church buddy, you are a scumbag. It is also disgusting in the least. Everyone on here likes to preach about the loss of their freedoms and rights. Imagine being one of those kids, with no rights, no free choice, no leaving the compound. Then when you hit 16 you have to fuck a greasy old religious bastard and pump out his offspring, while praising jesus the whole time. If thats what your god wants, I want NOTHING to do with your god. I don’t like cops. I don’t agree with about anything our government does. I don’t agree with the way the state handled this. But I do believe that the children from that place will have a better life outside of the walls of their parents compounds. And most importantly they will eventually be free to find their own paths in life, not the path that the church was going to choose for them.

    I would urge all parents to work out a plan with your child(ren) in the event of an unwanted intrusion by the State. Work out details of how your child(ren) will contact you, such as a prepaid cell phone, teaching the child(ren) how to make a collect phone call (to a prepaid cell phone), relaying their wherabouts to you, and lastly arranging that all important rendezvous in the dead of night. Since the State could not care less about the safety or well being of your child(ren), they will simply assume that the child has run away and there is nothing that they can do about it. Of course, they will never tell you and will hope that you will never contact them in regards to your child(ren). If, by some stretch of the imagination, the State does contact you, you can always say, “How should I know, I thought you had them.” My scenario is oversimplified, and there are many additional details to consider, but I suppose it all depends on whether or not you can sleep at night knowing that your kid(s) are in some hell hole with no shortage of sex offenders or drug addicts nearby.

    These women wear no makeup. They don’t color their hair. They are completely and utterly natural and honest people. I have no reason to doubt their word at all. This whole episode is a contrived plot to remove the children and break up a polygamist sect. For what purpose the powers that be are doing this, I’m not entirely sure, as they, themselves, have proven themselves to be - time and time again - the worst perverts on the planet. If I had to venture a guess for their motives, I’d say it is not outside the realm of possibility that this is a move to achieve two simultaneous objectives: (1) to prepare the general population for martial law and (2) to possibly supply the perverts running CPS with a new stock of “fresh meat” to abuse. A third possibility is that this is also designed to show that they can - and WILL - break ALL families, which have traditionally been an obstacle to their goals. They are simply starting with these people. Who will be next?

    I am astounded that the author of this article actually said “You can’t take a female judge out for a good horsewhipping when one is warranted.”.. You can’t “horse whip” a male judge or any human being actually… It is disappointing that when people who truly value America, its Constitution and its true principles undermine their standing by making stupid remarks such as this. This is one of the reasons that the people trying to return America to a place of liberty and constitutional principles are so often marginalized and treated as wackos….

    Regarding this situation in Texas, the government overstepped their authority and violated the rights of hundreds of men, women and children. This situation needs to be investigated and I’m certain that numerous people should see jail time for their participation in some very heinous acts. But we have a system and that system of law must be adhered to if we are going to remain a free country. The corruption of state/government/police power is just as much a crime as polygamy.

    You should witness the responses at some other sites–”Janet Reno was right she should have set a match to these freaks also”. Allegations of sexual abuse, welfare fraud,the missing Sarah who happens to be a 33 yr.old lady. I believe she has been charged with a misdemeanor. Mr. Jeffs was apparently a racist, but he was no longer at this uh…compound?.
    This has everything political about it. Abolishment of tax exempt status for all “churches”. “Their clothes are funny looking”. Poison documents inside the compound. No clear identities for the young children. Yet these same children receive food stamps and welfare? I don’t think that can happen. “The women weren’t allowed an education”. Apparently some were,some were teachers. I have been discouraged by all this. I’m so confused at this point I don’t know what to think. I don’t practice that faith, but don’t worry we won’t be able to practice any faith soon. I doubt we have any rights much longer to a personal opinion. Their belief system is totally alien to me. But, I don’t believe children should be “burned at the stake” to satisfy political agendas. If this is what this is…I don’t really understand why armoured personnel carriers or tanks should have been
    at the homes of these people.

    It seems California and Florida are on a race to see who can become a police state first. This way the rest fall in step with the lead sheeple states. Maybe these judges win a consulation prize from the Rockefellers which in their eyes makes it all worth helping run those child kidnapping rings and child sex slave rings, which in turn distribute child porn on the net to get more solutions for taking more children to use and abuse like a napkin at their dinner table. I especially deplore crimes against children but this is a crime in itself acting like they are the saviors of these children and their poor little souls can’t fight back.     PLEASE READ THIS!! This is a disgusting event that I witnessed personally and was punished by my professor for not “Towing the party line”. A few years ago, while going to nursing school, I witnessed one of the cruelest things I’ve ever witnessed, and beleive me I’ve served in corrupt countries full of starvation and suffering. While in school, I was doing my pediatric intensive care unit rotations and my “patient” was a premature female that was born in a tent on an island in the middle of the river, to two homeless people with severe psychological issues. They had spent every moment with thier daughter and were very loving and kind parents, it was my job to observe them for attachment, proper handling, etc. in addition to my nursing skills of I.V.s, and medications, etc. There had been rumblings that CPS was planning on taking the baby and giving her to a foster home, when she was healthy enough to travel. For obvious reasons, the people weren’t in a position to provide for this premature baby. The father had immediately went to find work and had a home located on a cattle ranch where he was going to work. The police said “we’ve had problems with this guy before, he’s a combat vet and very tough, he will cause problems when we take his child”. The CPS and police asked me “Will you assist us if he becomes combative?”, because I’m a big guy and worked on the psych and headtrauma unit they really wanted me to help. I asked them “You want me to help you kidnapp these people’s baby, because they’re homeless, and you won’t allow them to say good bye or even touch their baby, and your not giving them a chance even though they’ve found a home and employment?” Then they said “Yes” and I could she that bitch from CPS salivating just dying to steal this child, from the place the parents brought their child to for help. I refused their request and I said “You people need to rethink what youre doing, can you live with yourselves, why not allow them to say goodbye and have some closure? I’m here to help people and to do some good, not to be a government kiddnapping bitch baby. I hope the father kicks the shit out of all of you!” In the end, they swept in, grabbed the screaming newborn, wrestled the parents to the ground, medicated them because “they weren’t acting resonably and were resisting police instruction”. I just stood there and watched in disgust and tried to calm the parents as best I could. IT was so very disgusting. They weren’t even allowed to say goodbye. I wrote my paper as required by the class, and voiced my strong disapproval for what and how it had been done, those people had ABSOLUTELY NO RIGHTS! I got a failing grade from the bitches that ran the nursing program, because “You should always suppoport the police and the CPS, no matter what”. I was furious! I told the instructor that the only time I would ever do that is when they kick in her door and exterminate her family because those that support these things deserve to have it happen to them first! A year later I ran into the father while I was volunteering at the shelter, he told me thank you for trying to save his family, sadly he told me his wife had committed suicide and drowned herself in the river after they took her child. I’ve even had my best friends children taken like this because a neighbor didn’t approve of him spanking his child for stealing the neighbors childs bicycle. Luckily, there wasn’t anything else so they were returned two days later. Personally, I think they knew he was getting ready to take them back and was loading to kill everyone in the way. These poeple are evil, make no mistake.

    The ‘Old America’ suggests we protest. We are obviously living under a ‘New America’. The ‘New America’ doesn’t respond to protests - everything now has financial meaning. This situation is no different, someone is getting paid big bucks to do this - and someone is dishing out big bucks to do this.

    WE MUST BE SMARTER THAN THEY ARE AND ORGANIZE! I see a lot of the same dissent in here, but its all over the place with similar underlying frustrations. Again, we must find a way to organize ourselves before its too late. When I saw images of a tank with the word ‘Sheriff’ on it, I knew right then and there that it is now official - the Police State is here.     We have to be careful not to let a very dumb remark by the author about horsewhipping, &c. (and I agree entirely with Greg on the 19th about how this reflects badly on us and shoots us in the foot) detract from a lot of fine and well couched evidence of miscarried justice.

    Especially important are the absence of checking on “Sarah”s legitimacy, the well-founded statistics that State care is the place of greatest risk of child abuse (”the cure is worse than the disease”) and the excellent point made in the video near the end about the crass and venal motivation of Big Pharma. Those drug tallies are just like cost-plus contracts in Iraq: the more money you waste, the bigger your paycheck. If the truck blows a tire, abandon it. Give the child drugs — if it makes them sick, give them more drugs, and VERY EXPENSIVE drugs they are.

Several years ago when I came home from the Army I joined a Church near the Everglades. One of the member Families in the Church was undergoing a very difficult ordeal. Their two minor Children had been forcefully taken from them because the younger boy had endure a minor cut on his knee while playing outside, his Mom put some ointment on it. But as is often the case (specially with Kids) his cut became infected several days later. His Parents took him to the Hospital to have his cut checked out. Little did they know that this would be a decision that would completely turn their lives upside down. The scumbag Doctor decided to get the Department of Children & Families involved in this minor medical issue. Well, as is the case when you get Government scum involved in something is usually the innocent who pay the price. The Children were taken away forcefully and deprived of any contact with their two hard working loving Parents. I wonder if these maggots stop to think of the psychological damage that they must have caused those Children over something so trivial as a minor scrape on the knee? I’ll bet you anything that ruthless gaggle of Affirmative Action ilk simply does not give a shit about such Human emotions, mush less care about destroying Families! The entire repugnant ordeal dragged out for over a month before this Family got their Kids back. A Government paid psychologist even went as far as to advise the Judge presiding over the case “to denied them custody of their own Kids because the Mother had a mental illness“, and to what did this walking pile of Human waste attribute such an outlandish allegation?…get this, the fact that she is Religious, during one of the Court required meetings with this so-called psychologist she was asked how she felt about the ordeal, talk about stupid questions! I wonder if this Einstein Psychologist got his Degreed in some shoe factory? To this idiotic question she answer that her faith would see her through, and that God would not abandon her Family. The Government Psychologist took this as her been crazy, and committed perjury in Court and said that “she expected God to care for her kids”. So to these rats your faith is an excuse for Government to come into your life and destroy your family. Eventually their Kids were returned, but only after putting an innocent Family through such an ordeal.     I was shocked when I saw this story in the news. Look, I’m not much of a supporter of people who marry underage girls to their cousins, but I’m not so stupid to believe these people are a gang of children-rapers. If anything, those children will be far more traumatized by their experience in state custody than anything they experienced with their parents, families, and community.

    What the government is REALLY afraid of is Americans forming their own communities outside of the accepted, state-sponsored, suburban lifestyle. These people aren’t drones of the state, and that scares the state. God forbid they encourage other Americans to start forming their own communities!     Let people live the way they want to live. If plural marriage was legal, you wouldn’t have so much isolation and potential abuse and incest.     Americans aren’t allowed to create noticeable communities outside of the state sponsored realm. As a comparison, there was a more liberal type of community being built in Florida. They started getting wide attention. Their permits were revoked and the people’s land was confiscated.
